The following model interlocal agreement is between two government agencies – the Public Health Authority and the school district. It is detailed and clearly defines the responsibilities or obligations of the parties in the event of a public health emergency. An interlocal agreement is used when a district provides or receives a service to a local government agency, i.e. a city, county or training service centre (CSS). These agreements comply with the Interlocal Cooperation Contracts Act, Chapter 791 of the Texas Government Code. This provision aims to increase the effectiveness and efficiency of local governments by allowing them to enter into contracts with each other. For example, the local health authority and the local ISD may enter into an inter-local agreement to use school district facilities to deliver medication during a pandemic. Inter-municipal agreements usually require the approval of the board of directors.
